CHETAK LOGISTICS LIMITED WAY BILL

This Way Bill is regarded as a "Contract" between Owners or Dispatchers of the goods specified on the face of this Way Bill on the one hand and Chetak Logistics Limited, hereinafter referred to as "CHETAK LOGISTICS LIMITED" (which terms shall includes its employees, Servants, Agents) on the other hand for the transportation of the said goods as booked from booking station specified on Way Bill to the Destination station.

This Way Bill is NOT NEGOTIABLE with any Bank / finance company or financial institution.

All shipments carried under this Way Bill are carried under the Carriers Act and at Owner's risk unless & until specifically agreed to by Chetak Logistics Limited by charging specific risk charges as mentioned on the front of this Way Bill.

GOODS CARRIED BY CHETAK LOGISTICS LIMITED

Chetak Logistics Limited accepts all kinds of goods for transportation like: Valuables, Commercial Documents, Literature, Sophisticated/ High Technology Goods, Papers, Manuscripts, Securities of all kinds, Materials, Merchandise, Trade Samples and Explosives, Hazardous, Inflammable, Combustible, Contraband & Prohibited Goods, Bullion, Gems, Currency Notes etc. Chetak Logistics Limited has the right but not obligation to open and/or inspect any or all consignments. Every shipment shall be charged as per its chargeable weight and not as per actual weight.

CARRIER TERMS & CONDITIONS

'Chetak Logistics Limited', hereby agrees to carry the goods from booking station (Consignor) to the destination station (Consignee) as specified on the face of this Way Bill on terms and conditions as set hereunder:-

All goods are accepted for transportation by Road, Rail, Air or Sea at the sole discretion of Chetak Logistics Limited to carry the goods through any media as it may deem fit. No employees except the Management of Chetak Logistics Limited may in any manner alter or modify the terms and conditions set on this Way Bill. The Consignments are accepted for transportation by Chetak Logistics Limited on Consignor(s) declaration that their consignment does not contain any CONTRABAND or PROHIBITED GOODS and is properly packed, marked and addressed so as to ensure safe transportation and delivery. The Consignor(s) acknowledges that Chetak Logistics Limited is not a "Common Carrier" and that Chetak Logistics Limited at all times shall have the right to refuse any goods offered for transportation without assigning any reason whatsoever.

As the contents, nature, quality, condition and value of the subject consignment are unknown to Chetak Logistics Limited and the same has been accepted (as packed and declared by the owners) in good faith for transportation as indicated on the face of this Way Bill, therefore, Chetak Logistics Limited shall not, in any way, be kept responsible or liable to the Consignor and / or Consignee for any loss / damages to or non-delivery of the subject consignment, attributable to or caused by any incorrect or false declaration and / or defective packing, marking or addressing on the subject consignment by consignor, but the consignor shall be responsible and liable to Chetak Logistics Limited for all the consequences of their improper actions as above.

The Consignor/Consignee shall without any limitation be solely liable to Chetak Logistics Limited for all costs and expenses which would include Octroi / Taxes / Levies / Imposts Duties / Demurrage charges / Warehousing charges related to the consignment.

4.

LIEN ON CONSIGNMENT

Chetak Logistics Limited shall have a general lien on consignment (s) in case the consignee fails to pay the Freight, Octroi, State and Local Taxes or other charges on the consignment due to any reason. Chetak Logistics Limited may refuse to surrender possession of goods until such charges are paid.

5.

LIMITATION OF CHETAK LOGISTICS LIMITED LIABLITY

The liability of Chetak Logistics Limited to the Consignor/Consignee for any loss or damage or non delivery of the subject consignment shall be limited to Rs. 1,000/- (Rupees One Thousand Only) for non-commercial goods and for documents, unless otherwise agreed to any specifically declared on the face of this Way Bill.

6.

LIMITATION OF THE COMPANY'S LIABLITIES NOT ASSUMED BY THE COMPANY

The company will use its best endeavors to effect delivery of the Subject Consignment as agreed. Chetak Logistics Limited will not, in any circumstances, assume any responsibility or liability for any loss (direct or consequential, irrespective of the amount involved) alleged to have been sustained by the Consignor/Consignee arising out of or caused by delay in the pick-up, transportation and delivery of the subject Consignment due to:

( a ) Act of God, Force Majeure, Natural Calamities, floods or convulsions of nature, any explosion, accidents to the carrying vehicles or by the action of terrorists, militants or activists or by persons acting from a political motive, or caused by or resulting from strikes, lock-outs, labour disturbances, riots or civil commotions, etc., provided Chetak Logistics Limited has exercised reasonable care and precautions in the transportation of the subject consignment.

( b ) Any act, default, omission on the part of the Consignor/Consignee or any other interested third party, howsoever arising.

( c )"Inherent Vice" of the nature or any special characteristics of the subject Consignment and;

( d ) Electric or Magnetic injury, erasure or other such damage to photographic or Electronic Pictures, images or recordings in ay form.

7.

CLAIM FOR LOSS OR DAMAGE TO THE SUBJECT CONSIGNMENT

No claim shall be entertained by Chetak Logistics Limited until all its transportation charges etc., or any outstanding are paid by the CONSIGNOR OR CONSIGNEE as the case may be and if any claim arises against subject consignment, it should be brought to the notice of the Company in writing within 7 days from the date of booking at the booking station. Any such claim will not be entertained by the Company after expiry of 10 days from the date of Booking.

8.

This contract shall not insure to the benefit of any or the General Insurers operating in India.

No suit shall be filed against Chetak Logistics Limited In relation to the subject consignment after the expiry of 3 months from the date of booking.

10.

JURISDICTION

The competent court in the state of Delhi alone shall have jurisdiction in respect of all claims and / or matters pertaining to the subject Consignment arising out of the contract.

11.

If the Consignor/Consignee does not lift the material within 15 days from the date of Way Bill then Chetak Logistics Limited shall charge @ Rs. 10 paise / per day/ per kg to recover the transportation, Warehouse / Demurrage, handling & administrative charges of the said consignment.
